Also the post is quite long, but that's because I wanted to get the details in so as to avoid leaving out anything possibly relevant. The brand new offence of wilful negligence, then again, (if modeled on the prevailing offence underneath the Mental Capacity Act) will probably be a conduct offence - a heathcare worker could be discovered guilty even if the wilful negligence did not result in any harm. Dr. Recker: I do see this point in the evolution of dental specialties as one that clearly offers the opportunity for advancement in training, education and experience in all non-ADA recognized specialties and for developing a fair and objective alternative for determining dental specialties. The ABDS (American Board of Dental Specialties) was formed to model the ABMS medical model. It is intended to be a joint cooperative between an independent entity (ABDS) and, hopefully, organized dentistry (ADA). The decisions of the ABDS relative to specialties will not consider competition, political issues, or turf wars. It will not be a decision made by a group of competitors who could be economically or politically affected by their own decisions. While such a statement is not intended to be critical of the ADA specialty recognition process, it is a simple reality. Sometime in mid-March, Mr. DeJesus called his wife, again asking to see Felicia and The first thing you'll probably notice is that the electronic medical record will look different, depending upon where it was printed. If it is printed somewhere where it is not intended to be part of a record that is being officially provided pursuant to a medical records authorization, it will have unofficial copy not for record release on it. If it is printed pursuant to a medical release, it will not have these words on it. This can be tremendously frustrating and makes it difficult to compare the medical records that the client provided to you before suit, with what you will receive from the government. As I indicated earlier, the veteran's VISTA CPRS, file does not contain all of the data for your client. It will point to where thousands of other pieces of data reside. When the medical records department prints your client's file, the results that you will receive will be based on the information that is available to that user, based on that user's level of access to information in the system, as well as what the user chooses to print out and provide to you. The VISTA CPRS system includes a lot of information about the veteran, which you may not truly think of as part of a medical record, for example there may be a lot of information contained within this record about your client's eligibility for various VA benefits. VISTA CPRS also houses risk management reports concerning your client which are protected from disclosure by statute, which the medical records staff will not have access to and cannot print it even if they wanted to. Many of us probably send medical records authorizations asking for the entire medical record. Even when one uses the VA's VHA Form 10-5345 REQUEST FOR AND AUTHORIZATION TO RELEASE MEDICAL RECORDS one is not likely to get all of the records. This form is designed to mislead the veteran and allow the VA to release whatever it chooses to release as the language used on the form does not even match the VA's own definitions. The VHA HANDBOOK 1907.1 (April 15, 2004) defines medical record as: Seeking Justice For All Types Of Medical Malpractice Plaintiff then met with Larry Seidl, M.D., an internist who was chief of staff at the Denver VA hospital, who agreed to become his primary treating physician. When plaintiff was hospitalized in 1987 for a kidney and urinary tract infection, he again became concerned with the quality of his treatment at the Denver VA hospital. Dr. Seidl ultimately drafted a document titled Important Notice to All Physicians Treating John Deasy (Dr. Seidl's notice). II 367. The notice contained information about plaintiff's medical history, including his primary diagnosis of idiopathic retroperitoneal fibrosis, and briefly outlining the physical and psychiatric treatments he had received. The notice stated that what Mr Deasy justifiably seeks is to obtain the optimum treatment available for his unusual medical condition and to avoid improper and ineffective or harmful treatment-which he has experienced in the past-based on review of his medical records, which include diagnoses, both medical and psychiatric, that are highly suspect, in my opinion. Id. The notice explained that the psychiatric diagnoses in plaintiff's history are highly suspect because they have occurred either during a period when his Ormond's disease has been active with secondary renal function impairment and its resulting toxicity; or they have occurred during periods when he was receiving multiple medications including corticosteroids to control the Ormond's disease which became active undiagnosed-to be detected only later when it interfered with other organ functions. From December 1976 through August 1980, his psychiatric diagnoses included chronic schizophrenia, manic-depressive psychosis and organic brain syndrome. It is more than highly probable in my opinion that his mental symptoms resulted from the adverse effects of multiple medications including corticosteroids. During this period, he experienced an active phase of the Ormond's disease initially undetected, which caused common bile duct obstruction and the removal of an acalculus gall bladder. Subsequently the inferior vena cava syndrome developed secondary to the fibrosis. It should be noted here that during 357periods when the Ormond's disease is active, Mr. Deasy may be highly sensitive to drugs and drug therapy of any kind should be conservative and closely monitored. The toxic side-effects of his underlying disease and its treatment should always receive primary consideration in evaluating Mr. Deasy's mental and emotional symptoms during treatment in the Veterans Administration Department of Medicine and Surgery. The Housing Part of the Civil Court of the City of New York has been clearly granted statutory authority pursuant to RPAPL paragraph235-c to declare the alleged twelve (12) year lease agreement at a monthly rent of $590.00 for the duplex Penthouse in Brooklyn unconscionable. RPAPL paragraph235-c provides, in relevant part, as follows: If the court, as a matter of law, finds a lease or any clause of the lease to have been unconscionable at the time it was made, the court may refuse to enforce the lease, or it may enforce the remainder of the lease without the 14unconscionable clause, or it may so limit the application of any unconscionable clause as to avoid any unconscionable result. As compelling, Section 2 of the statute provides that when it is claimed or appears to the court that the lease or any clause thereof may be unconscionable, the parties shall be afforded a reasonable opportunity to present evidence as to its setting, purpose and effect to aid the court in making the determination. This is not a new statute. It is well known to those attorneys that practice Landlord and Tenant law. The statute was enacted in 1976, effective July 26, 1976, and is applicable to all leases regardless of when executed in this state. No evidence, testimonial or otherwise, was introduced to show that BEINERT retained or consulted a Landlord and Tenant attorney notwithstanding the fact that he stated he was a veteran in the Landlord and Tenant Court. Even those that are experts consult with others in decision-making particularly in the legal profession. The complete proposed rule change can be found at:

The 17-year-old was sent to his home near Lawrence, Kansas on the following Sunday. Then he had a high fever and went to another hospital in Lawrence two days later. It's not clear what happened at that visit, but he didn't get definitive care until two more days when he was back in the Lawrence hospital with another fever and a blistered foot. That brought him to the care of the surgeon in Kansas City who told the young man he had to amputate to save his life. Steals client money or commingles funds

I took Methotrexate for about a year when I started having severe stomache bloating, and developing large bruises all over. Soon after severe abdominal pain that radiates to the back developed. It was acute pancreatitis, which has now progressed to Chronic Pancreatitis. At hospital I was told it was the methotrexate that killed my pancreas. I am in misery daily and have been enduring a 8 month wait to see a pain specialist. Found out that I also have mild heart disease, and a fatty liver. The rheumatoligist that put me on methotrexate checked liver enzymes, but no biopsy. I stopped taking the drug because it was killing me. My system was reacting blood counts were off, and I became so weak I could hardly get out of bed or function. I expierenced many falls I think because of the weakness it caused in my body. The drug was doing more harm than good for me, and left me with a failing pancreas, and possibly harm to liver as well. I will need to have pancreas removed, and islet cell transplant, but my insurance wont cover the transplant portion of the surgery I need. I regret ever having taken this drug for my RA.
